Is AI Cold Outreach Legal? TCPA, CAN-SPAM, FTSA
Is AI cold outreach legal? The basics of the TCPA, CAN-SPAM and the Florida Telephone Solicitation Act for businesses, and what to ask before you automate.
Is AI cold outreach legal?
Often yes, but it depends on the channel. Cold email is generally lawful in the United States if it follows CAN-SPAM. Autodialed or prerecorded calls and marketing texts are far stricter under the TCPA and Florida's telephone solicitation law, and usually need prior written consent. Using AI does not change the rules; it only makes violations faster.
This post is general information, not legal advice. Laws change and facts differ. Have your own attorney review any outreach program before it goes live.
Why does the channel matter more than the AI?
The law regulates the act of contacting people, not the tool that writes the message. An email drafted by a person and an email drafted by a model are judged the same way. What changes with AI is volume and speed: a system can contact thousands of people before anyone notices a mistake.
That is why the useful question is not whether AI is allowed. It is which channel you use, who you contact, what consent you hold and whether you can stop instantly when someone says no.
What does CAN-SPAM require for cold email?
CAN-SPAM is the federal law for commercial email, and it applies to business-to-business email too. It does not require permission before you send a first message, but it does set rules for how you send. The core requirements are well established.
- • Honest headers and subject lines. The sender information and subject must not mislead.
- • Say it is an ad when the message is promotional, in a clear way.
- • A valid physical postal address for your business in every message.
- • A working opt-out. Honor unsubscribe requests promptly, within the legal time limit, and never sell or share the address afterward.
Your email provider's own sending rules may be stricter than the law, and ignoring them can get your domain blocked long before a regulator notices. Check the current FTC guidance on CAN-SPAM for the exact text.
What does the TCPA say about calls and texts?
The Telephone Consumer Protection Act restricts calls and texts made with an automatic dialing system or an artificial or prerecorded voice. For marketing messages to mobile numbers, the rules generally require the recipient's prior express written consent. Fines and private lawsuits are the enforcement tools, and statutory damages are assessed per message.
The FCC has also ruled that AI-generated voices count as an artificial voice under the TCPA. So a call that uses a synthetic voice to pitch someone, without their consent, is treated like a prerecorded robocall. Separately, the National Do Not Call Registry and the rules on calling hours apply to telemarketing calls.
What is the Florida Telephone Solicitation Act?
Florida's telephone solicitation law, often called the FTSA, adds state-level rules for sales calls and texts to Florida numbers. It generally bars automated or prerecorded sales calls and texts without prior express written consent, limits calling hours, caps repeat attempts in a day, and gives people a private right to sue.
Florida amended the statute more than once in recent years, so the details, including definitions and defenses, are worth checking against the current text. Companies that contact Florida residents should assume the state law applies even when they are located elsewhere.
How do the three laws compare?
The same outreach plan can be fine on one channel and risky on another, so it helps to see them side by side. This table is a simplified summary of general rules, not a full statement of the law, and exceptions exist.
| CAN-SPAM | TCPA | Florida FTSA | |
|---|---|---|---|
| Covers | Commercial email | Calls and texts, federal | Sales calls and texts, Florida |
| First contact without consent | Generally allowed if rules are followed | Generally not allowed for autodialed or prerecorded marketing | Generally not allowed for automated marketing |
| Consent standard | None for a first email, opt-out afterward | Prior express written consent for marketing | Prior express written consent |
| Opt-out | Required and honored promptly | Must be honored | Must be honored |
| Who can enforce | FTC and other authorities | FCC, states and private plaintiffs | State and private plaintiffs |
How should AI outreach be built to stay on the right side of this?
Build the compliance into the system, not into a document nobody reads. A well-built outbound system keeps a record of where each contact came from and what consent exists, checks a suppression list before every send, and stops automatically when someone opts out in any channel.
Four design habits matter most:
- • Consent records. Store the source, timestamp and wording of the consent for every phone number.
- • Suppression lists. Check them before each message and keep them across tools.
- • Human review. Approve templates and sample outputs, and keep a person in the loop for replies that are not routine.
- • Sensible limits. Cap daily volume, respect calling hours and stop on the first clear no.
Can an AI handle replies to cold outreach?
Yes, and that is where most of the value is. Handling replies, qualifying interest and booking a call are inbound-style tasks once the person has answered you. The cautious design is to automate follow-up and routing while keeping the first-contact rules strict. See AI outbound lead generation for Florida businesses for how we scope this work.
Frequently asked questions
Is cold email to businesses covered by CAN-SPAM?
Yes. CAN-SPAM covers commercial email whether the recipient is a consumer or a business.
Can an AI voice call a lead?
Only with the right consent. An AI voice is treated as an artificial voice under the TCPA, so marketing calls to mobile numbers generally need prior express written consent.
Does the Do Not Call list apply to business numbers?
The registry is aimed at residential numbers, but calls to mobile phones used for business can still raise TCPA issues. Ask your attorney about your specific list.
Who is liable if a vendor sends the messages?
Often the business that benefits can be responsible too. Choose vendors who document consent and opt-out handling, and ask for it in writing.
Where do I start?
Start with email and replies, keep calls and texts consent-based, and have an attorney review the program.
